I believe the Mitsu EVO's can have a routine written into their program to do the same no matter what engine mods or ECU map settings. It just says pass to all the emissions and spits out whats required. Some smart people out there. Great to see they have been busted. You would think a manufacturer would do their best to comply. I do know some cars sold in Australia only just pass when new while others pass for many years. Festy might get offended but I believe Alfa had some serious issues quiet some time ago. Talking back in the days of carbies.

Speaking of emission I was actually going to start a thread the other day about why all new cars pour black smoke under the slightest acceleration and some even continuously when cruising on the highway.
I noticed bitsareshiity, volkwagen, ford territoy and many of the small European cars do it. The large hyundais are shocking too, smoke screen they are.

Because if you look at the ADR test cycle there is nowhere you have to put your foot to the floor. The whole cycle can be completed with fairly light throttle so at wide open throttle there is no rule book except for the smoke issue but as long as it doesn't last for more than 10 seconds it's OK.

GM got dragged over the coals in the US A number of years back to do with lean cruise.
Hence the reason there is a interest in GM LS1 Aussie tunes as ours had lean cruise enabled.
Pretty sure all manufacturers will have some "cheats" built in, it's just a matter of when they'll get caught as people disassemble there tunes in years to come. What's impossible now maybe considered fairly simple in 5-10 years time.
